Acceptable Use Policy

1. Permitted Listings

SpareHolidays permits the listing and sale of the following four categories of travel products, provided they are genuine, valid, and legally transferable: airline tickets and flight reservations that allow name changes or transfers under the carrier's policy; hotel reservations that can be modified to change the guest name or are otherwise transferable; travel packages whose included bookings can all be transferred to the buyer; and travel vouchers and credits issued by airlines, hotels, or travel agencies that are assignable to another person.

All listed items must be accurately described with complete and truthful information, including the travel provider, booking dates, class of service, transfer restrictions, expiration dates, and any fees the buyer may incur from the travel provider to complete the name change. Sellers must have verified that the specific booking or product is eligible for transfer before creating a listing.

Listings must include a clear and fair price that reflects the value of the travel product. Sellers are encouraged to provide as much detail as possible to help buyers make informed decisions. Listing images and descriptions must accurately represent the product being sold.

2. Prohibited Listings

The following types of listings are strictly prohibited on SpareHolidays: bookings or tickets that are explicitly non-transferable under the travel provider's terms and conditions, with no available name change option; expired travel products, including bookings with past travel dates, expired vouchers, or lapsed loyalty points; stolen, fraudulently obtained, or otherwise illegally acquired travel products; and travel products owned by a third party without that party's verified written authorization.

Also prohibited are: listings for travel products obtained through the exploitation of pricing errors unless the travel provider has honored the price; counterfeit or forged booking confirmations, vouchers, or loyalty point balances; bundled listings that combine transferable and non-transferable elements without clear disclosure; and any listing that would require the buyer to impersonate the seller or use the seller's identity documents to travel.

SpareHolidays reserves the right to remove any listing that we determine, in our sole discretion, violates this policy, poses a risk to buyers, or may expose SpareHolidays to legal liability. Repeated violations may result in account suspension or permanent ban, as described in Section 6 of this policy.

3. Prohibited Conduct

Users of SpareHolidays must not engage in the following conduct: any form of fraud, including misrepresenting the nature, value, or transferability of listed travel products; creating or publishing fake reviews, ratings, or testimonials to artificially inflate or deflate a user's reputation; price manipulation schemes, including shill bidding, creating fake competing listings, or colluding with other users to distort market prices.

Further prohibited conduct includes: harassment, threats, intimidation, or abusive behavior toward other users, SpareHolidays staff, or dispute resolution personnel; attempts to circumvent SpareHolidays' payment and transfer process, including arranging off-platform payments, requesting direct bank transfers, or persuading buyers to confirm receipt before actually verifying the transfer; creating multiple accounts to evade enforcement actions or manipulate the platform; and interfering with the operation of the Platform, including attempts to exploit bugs, vulnerabilities, or automated systems.

Users must not use the Platform for money laundering, terrorist financing, or any other illegal purpose. Any suspected illegal activity will be reported to the appropriate law enforcement authorities. Users must comply with all applicable local, national, and international laws and regulations in connection with their use of the Platform.

4. Seller Obligations

Sellers on SpareHolidays have the following obligations: provide accurate, complete, and truthful descriptions of all listed travel products, including any limitations, restrictions, fees, or conditions that may affect the buyer; initiate the transfer or name change process promptly after a sale is confirmed and within the timeframe specified in the listing or required by the Platform; and upload clear, authentic proof of transfer completion through the Platform's structured transfer system.

Sellers must respond to buyer inquiries and dispute filings in a timely manner, providing truthful information and relevant documentation when requested. Sellers must not instruct buyers to confirm receipt of a transfer before the buyer has independently verified that the booking has been successfully transferred to their name.

Sellers are responsible for ensuring they have the legal right to sell the listed travel product and that the transfer complies with the travel provider's terms and conditions. If a seller discovers that a listed product cannot be transferred after a sale is confirmed, they must immediately notify SpareHolidays and the buyer. Failure to fulfill seller obligations may result in automatic cancellation of the transaction, forfeiture of fees, and enforcement actions against the seller's account.

5. AI Assistance & Human Review

With your consent, AI may read the files you provide and suggest information to prefill listing fields. This is best-effort assistance: you confirm the details, and it is not verification, approval, or a public trust badge. AI output may also flag possible issues for our reviewers, but it does not restrict, suspend, reject, or remove a listing.

For ordinary seller submissions: When you submit your listing, it enters our review queue. A person checks it, and it becomes public only after approval. A recorded human moderation decision is required for policy enforcement against a listing. Sellers are notified of the decision and the reason.

You may appeal a human moderation decision through the Platform's support center. The appeal will be reviewed by a human team member who was not involved in the original decision.

6. Enforcement Actions

SpareHolidays enforces this Acceptable Use Policy through a graduated system of enforcement actions, which may include: a formal warning issued to the user's account, documenting the specific violation and expected corrective action; removal of the offending listing or content from the Platform; temporary suspension of the user's ability to create new listings, make purchases, or withdraw funds; permanent suspension or termination of the user's account; and, in cases involving fraud, theft, or other illegal conduct, referral to law enforcement and potential legal action.

The severity of enforcement action is determined based on the nature and gravity of the violation, the user's history of compliance, the impact on other users, and whether the violation appears intentional or accidental. SpareHolidays reserves the right to skip graduated steps and impose immediate severe action, including permanent bans, in cases of egregious violations such as fraud, illegal activity, or threats to user safety.

Users who receive enforcement actions will be notified via email and in-app notification with an explanation of the violation and the action taken. Users may appeal enforcement decisions by contacting our trust and safety team within thirty (30) days of the action. Appeals are reviewed by a senior team member and a final determination is communicated within ten (10) business days.
